Step 2 – Referral of Dispute to Private Residential Tenancies Board (PRTB)

In the event that a Tenant fails to comply with Notices served pursuant to Step 1 the Landlord is then entitled to refer the matter to the PRTB.

At this stage, landlordsolutions.ie will arrange for the dispute to be referred to the PRTB on the Landlord’s behalf and subsequently there will be a Hearing. There will be an option to avail of either Mediation or Adjudication in the PRTB.

Our Advocacy Team will also Defend a Landlord where a Tenant brings a claim against him or her and the options below will be modified accordingly.

The Landlord will have two options under Step 2

Option 1. Self-Representation

landlordsolutions.ie will provide for the completion of all dispute referral documentation to the PRTB on the Landlord’s behalf and in addition will consult with the Landlord and provide the Landlord with a tailored Hearing Package pertaining to the particular circumstances of the Landlord’s specific dispute and the procedure to be adopted by the PRTB at the Hearing. By selecting Option 1 the Landlord elects to represent himself or herself at the Hearing.

Option 2. Representation by landlordsolutions.ie

landlordsolutions.ie will provide for the completion of all dispute referral documentation to the PRTB on the Landlord’s behalf and will arrange for the Landlord to be represented by the landlordsolutions.ie Advocacy Team at the PRTB Hearing. This Option comprises a pre-hearing consultation, assistance in compiling all relevant documentation and/or witnesses, and presentation of the Landlord’s case at the Hearing. The representation will include examination of the Landlord and Landlord’s witnesses (if any) and cross-examination of the Tenant and Tenant’s witnesses (if any) at the Hearing. Choosing Option 2 in preference to Option 1 will significantly enhance the Landlord’s likelihood of success.
